TERMS OF SALES

Article 1 – Definitions

General Conditions: these general terms and conditions set up the relationship between CAWETTE JONES and its purchasing client. They must be read and accepted in their entirety by the purchasing customer, without any reservation or conditions, so that the purchaser client, duly informed, can proceed to the registration of his order and / or pre- order. No order and / or pre-order may be technically registered on the CAWETTE JONES website without the purchasing customer having previously expressly confirmed having read and accepted the General Conditions.

CAWETTE JONES : CAWETTE JONES is a simplified joint stock company with a capital of 1000.00 euros, with registered office at 75, rue Jean Mermoz, 04300 FORCALQUIER (France), registered 833 296 593 R.C.S. Manosque

Purchasing client : any major consumer customer who is a natural person acting for purposes that do not fall within the scope of his commercial, industrial, artisanal, liberal or agricultural activity.

Order : purchase made directly by the Purchasing Client on the CAWETTE JONES website, relating to a Product available in Stock, with immediate and full payment of the Price except in the case of payment in several installments.

Pre-Order Opening Date : the date from which the Purchasing Customer has the right to register a Pre-Order for a Product being manufactured and not yet available in Stock.

Days : every day of the week, except Saturdays, Sundays and public holidays (The Pentecost holiday included).

Pre-Order : special order made directly by the Purchasing Client on the website of CAWETTE JONES, concerning Products in the course of production and not yet available in Stock, by means of a firm reservation, with payment by the Purchasing Client of the full price, a deposit, or a payment in several installments. In case of cancellation, 30% (thirty percent) of the Price of each Product is non-refundable. CAWETTE JONES reserves the right to authorize pre-orders for the same products at its partner boutiques.

Price : price fixed by CAWETTE JONES for the Products, appearing on the website of CAWETTE JONES at the time of the conclusion of the contract of purchase / sale, and to be paid by the Purchasing Client for the acquisition of the Product.

Product : Collector’s item, new, printed and painted, manufactured and produced following a Prototype, in a limited number of copies, available only within the limit of the Stock, and intended for a public of persons over 15 years old. The Product is not a toy, but a collector’s item. CAWETTE JONES reserves the right to sell the Products directly to its Customers on its website or at its partner boutiques.

Prototype : The model on which the Products are made.

Stock : set of products already made available at CAWETTE JONES and / or its partner shops. In the event of a stock outage for a product, the order is canceled and any payment paid by the purchasing customer is fully reimbursed by CAWETTE JONES as soon as possible, with the option for the purchasing customer to replace the product with another Product. of his choice, and possible refund of the difference if the chosen Product is less expensive, or payment by the Purchaser of the surplus if the chosen Product is more expensive.

 

Article 2 – Scope

The General Conditions apply to all Purchasing Customers, excluding any other general conditions, special conditions, and any other documents that would be issued by the Buyer Customers themselves.

The fact, for the Customers purchasers, to record an Order or a Pre-Order on the site of CAWETTE JONES is worth express, complete and irrevocable adhesion, without reserve nor conditions, to the General Conditions.

CAWETTE JONES may agree with the Purchasing Client in writing of certain special conditions that are derogatory to the General Conditions (“Special Conditions”). The Special Conditions derogating from the General Conditions on certain points prevail, for these points, on the General Conditions.

CAWETTE JONES not availing itself at a given moment of any of the clauses of the General Conditions or Special Conditions can not be interpreted as being waived by CAWETTE JONES to take advantage later of these clauses.

CAWETTE JONES reserves the right to modify and update its Terms and Conditions at any time, without prior notice.

Article 3 – Order – Pre-Order – Conclusion of the contract of purchase / sale – Delivery – Termination

The Purchaser Client registers his Order or Pre-Order on the website of CAWETTE JONES following the instructions that are passed on to it, and after having confirmed its reading and acceptance of the General and Special Conditions.

The purchase / sale contract is valid and concluded between the Purchasing Client and CAWETTE JONES as soon as the purchasing client has registered his order or pre-order on the CAWETTE JONES website (“Date of conclusion of the contract of ‘buy Sell “).

In the event of an Order: The Purchaser Customer is expressly informed that the placing of the order obligates him to his immediate and full payment by validating his order on

the website of CAWETTE JONES “with obligation of payment” – this accuracy is clearly and legibly mentioned on the website of CAWETTE JONES.

The full payment of the price linked to the order may, in certain cases, be paid by the buyer client in a maximum of four (4) dates of payment. This payment option is directly visible to the buyer customer on the product sheet of the article if it is available.

In case of Pre-Order: The Price may be paid by the Purchasing Customer in a maximum of twelve (12) dates of payment. This payment option is directly visible to the buyer customer on the product sheet of the article if it is available.

The Product is only delivered after full payment of the balance of the Prize.

CAWETTE JONES reserves the right to cancel any order or pre-order in the event of non- payment by the purchaser of the price, the balance of the price, or the deposit.

The delivery period is not an essential condition of the purchase / sale contract, neither for the Order nor for the Pre-Order. That being so, CAWETTE JONES deploys the means that are available to deliver the Products within a reasonable time:

(i) Products that are the subject of an order are shipped and delivered by CAWETTE JONES to the Purchasing Customer within ten (10) days of the date of conclusion of the purchase / sale agreement.

(ii) The Products subject to a Pre-Order are shipped and delivered to the Customer following a delivery date which is specified on the website of CAWETTE JONES for information only, expressed in quarter, and estimated at about 3 (three) to four (4) quarters following the opening date of the Pre-Orders. The Purchasing Client is informed of the actual delivery date by CAWETTE JONES.

In the event that CAWETTE JONES does not comply with the aforementioned delivery time sub (i) or sub (ii), the Purchaser Customer has the right to order CAWETTE JONES to execute within a reasonable additional time, estimated at fifteen (15) additional days. Failing to comply with this new reasonable time, the Purchasing Customer has the right to terminate the purchase / sale contract, by registered letter with acknowledgment of receipt notified to CAWETTE JONES. The purchase / sale agreement thus resolved requires CAWETTE JONES to reimburse the Purchasing Client no later than 14 (fourteen) days following the date on which the said contract would have been denounced by the Purchasing Client. After this period, the amounts due to the Purchasing Client are automatically increased by 10% if the refund is made at the latest within 30 days, 20% up to 60 days and 50% later.

 

Article 4 – Right of withdrawal – Retraction form – Restitution

4.1 The Purchasing Customer has a withdrawal period of 14 (fourteen) days from the date of receipt of the Product (1st day of the date of payment) by the Purchasing Client or by the person who has received the Product in the name and the account of the Purchasing Client. The right of withdrawal may be exercised by the Purchasing Client before the expiry of this period of 14 (fourteen) days. In case of withdrawal, the Purchaser Customer bears all the costs including the costs of returning the Product to CAWETTE JONES.

4.2 To exercise the right of withdrawal, the purchaser client shall notify CAWETTE JONES of the Retraction Form or any other mail in which the Customer declares his unambiguous desire to retract. The Purchasing Customer must ensure that he retains proof of the exercise of his right of withdrawal, which is why CAWETTE JONES suggests that he exercises his right of withdrawal by sending him the duly completed Completion Form signed by registered mail with a request for withdrawal. ‘avis de réception (at CAWETTE JONES, 75 rue Jean Mermoz – 04300 FORCALQUIER – FRANCE) or by email (at the CAWETTE JONES after-sales service: cawette.jones81@gmail.com), making sure of sending and receiving workforce. The Purchasing Client does not have to justify reasons leading him to wish to exercise his right of withdrawal. Once the Purchasing Customer has notified CAWETTE JONES the exercise of its right of withdrawal, CAWETTE JONES reimburses the Purchaser Client, it being specified that, in accordance with the Consumer Code, and being a contract of purchase / sale, CAWETTE JONES reserves the right to defer this refund until receipt by CAWETTE JONES of the Product or proof of shipment by the Purchasing Customer (first of two dates). The Purchasing Customer who exercises his right of withdrawal is reimbursed the amount of the Price and the amount of the Fees (unless the Purchasing Client had chosen a non-standard delivery method and more expensive than the standard delivery method proposed by CAWETTE JONES). Case of delay of refund by CAWETTE JONES (after the reception of the Product or the proof of its forwarding), the sums due by CAWETTE JONES are automatically raised in accordance with the provisions of the Code of the consumption.

4.3 In the event of exercise of his right of retraction, the Purchaser Client has the obligation to restore to CAWETTE JONES the Product which had been delivered to him within another delay of 14 (fourteen) days following the sending of his own withdrawal, at the address of the head office of CAWETTE JONES (75 rue Jean Mermoz – 04300

FORCALQUIER – France). The Product thus returned must be in its original packaging, unopened, in perfect condition, undamaged in any manner whatsoever.

Article 5 – After-sales service

CAWETTE JONES invites the Purchasing Customer to inform it within fifteen (15) days after receipt of the product of any defects, breakages or damage that the Purchaser would have noticed and which the product would have suffered, by sending an email to the service after sale of CAWETTE JONES (cawette.jones81@gmail.com) photos and explanations for a possible refund, exchange or shipment of a replacement part within a reasonable time.

Article 6 – Legal guarantee of conformity

The Purchaser Client is fully aware that the Prototype photographed and displayed on the website of CAWETTE JONES is for the purpose of promoting the Product on said site, and to allow the Purchaser Customer, so informed, to proceed with its Orders and / or Pre- Orders. The Purchasing Customer expressly agrees that the Prototype thus photographed does not identify itself with the Product as such, and has no contractual value. The description of the Prototype, its characteristics and the pictures representing it are as close as possible to the Product, and serve an illustrative purpose. CAWETTE JONES is not responsible for any modifications made to the prototype by the manufacturer at the time of delivery.

CAWETTE JONES does not respond to defects of conformity of an existing Product at the time of its delivery. The purchasing customer can make known any lack of conformity to the company CAWETTE JONES in writing (mail or registered letter). These defects of conformity will then be communicated by the company CAWETTE JONES directly to the manufacturer. A defect of the Product occurring within 24 (twenty four) months is presumed to exist on the day of delivery, unless proven otherwise. The deadline for the Purchasing Client to act as a legal guarantee of conformity is 2 (two) years from the date of delivery of the product. However, the Purchasing Client can not claim a lack of conformity if he knew of it or could not ignore it.

In case of lack of conformity, the Purchaser Client has the choice between (i) repair of the Product by the manufacturer, or (ii) replacement of the Product by the manufacturer. The manufacturer has the right, however, to refuse such an election if it entails a manifestly excessive cost, taking into account the value of the Product or the extent of the defect, and in particular also in the event of a breakdown of the relevant Product’s Stock or Stock rupture of any other product coming close to it. If repair or replacement is not possible, the Purchasing Client has the option of requesting the full resolution of the purchase / sale contract or the return of part of the Price. The action as a legal guarantee of conformity does not deprive the Purchaser of a warranty claim against hidden defects.

Article 7 – Guarantee of hidden defects

In order for the Purchasing Client to implement the guarantee of hidden defects, the defect affecting the Product must in particular be prior to the purchase / sale contract and render the Product unfit for the use for which it is intended. The Purchaser Client can not act as a guarantee against hidden defects if he was aware of the defect affecting the product, it being specified that the apparent defect is assessed at the time of delivery, and that the quality / competence of the Purchasing Client is taken into account for the determination of his knowledge of the vice. CAWETTE JONES does not guarantee hidden defects when there is a defective use of the Product. The delay available to the Purchaser to act as a guarantee against hidden defects is 2 (two) years from the discovery of the defect. The Purchaser Client who acts as a guarantee against hidden defects has the choice between (i) the resolution of the sale, that is to say the return of the Product he had acquired and the reimbursement of the Price, or (ii) the reduction of the price, that is to say, keep the Product and be reimbursed part of the price.

Article 8 – Billing – Payment – Means of payment

The Purchasing Client is obliged to pay the full price when registering any Order. If there is Pre-Order, the Customer is obliged to pay the Deposit and the balance of the Price, possibly in several installments, free of charge, if he has opted for this possibility, at the time of the registration of his Pre-Order. VAT is applied in compliance with the law and regulations in force in France. The invoice (s) issued by CAWETTE JONES for the settlement of the Prize takes into account, if there is Pre-Order, the deposit that has been settled. The payment of the price is done by credit card (Carte Bleue, Visa card, Eurocard / Mastercard) or by Paypal. Payments are made in euros, subject to good collection. All taxes and all general expenses (such as, and without this list being exhaustive, bank charges, collection charges, exchange fees, customs fees, collection costs) are the sole responsibility of the Purchasing Client. (” Fresh “). Only shipping and delivery costs of the Product outside France are the responsibility of the Purchasing Customer. As such, unless otherwise expressly confirmed by the Purchasing Client on the website of CAWETTE JONES, at the time of registration of the Order or Pre-Order, it will be a standard shipping

and delivery charge that will be charged to the Purchasing Client. The Purchasing Customer can expressly opt for a non-standard and more expensive delivery method (private, express or faster). The Purchaser Customer has the obligation to pay the Price and the Costs without having the right to unilaterally make any compensation or reduction, withholding or suspension, of any nature whatsoever and for any reason whatsoever.

Article 9 – Limitation of liability

If the treatment reserved by CAWETTE JONES to the complaints and reservations formulated by the Purchaser Client does not meet the expectations of the Purchasing Client, the potential liability of CAWETTE JONES, if it were to be incurred, would be strictly limited to the amount of the Prize, and could not be extended to the direct or indirect consequences of the use by the Purchasing Client or any other person, natural or legal, of the Product.

Article 10 – Confidentiality

CAWETTE JONES is not responsible for the data, information or documents transmitted to it or communicated, by any means whatsoever, by the Purchasing Client. By the simple fact of having received them, CAWETTE JONES can not be presumed to have accepted them. CAWETTE JONES processes the information communicated to it by the Purchasing Client in accordance with the principle of confidentiality.

Article 11 – Retention of title

The Products delivered to the Purchaser Client are assigned to him with retention of title. The transfer of ownership is subject to the full payment of the Price by the Purchasing Client. In the event of total or partial non-performance of his obligations by the Purchasing Client – in particular in the event of non-payment of the full price in respect of only one of the agreed deadlines – the purchase / sale contract shall be automatically settled and CAWETTE JONES has the right to claim the Product at the expense and risk of the Purchaser, all sums and / or advances previously paid to CAWETTE JONES, without prejudice to any damages that may be claimed as a result of the resolution.

Article 12 – Notification – Election of domicile

All notices, notices and comments to be sent by the Purchasing Customer to CAWETTE JONES and vice versa are validly notified only if they are sent, according to the method of communication specified in the General Conditions:

– By the Purchasing Customer to CAWETTE JONES, at the address of its head office: CAWETTE JONES, 75 rue Jean Mermoz – 04300 Forcalquier, France or by email to its after- sales service cawette.jones81@gmail.com

– By CAWETTE JONES to the Purchasing Client: to the postal address or email indicated by the Purchasing Customer at the time of the registration of his Order or Pre-Order.

Article 13 – Validity

The invalidity or inapplicability of any provision of the General Conditions shall not entail the nullity or inapplicability of the other provisions of the General Conditions.

Article 14 – Applicable law

The General Conditions, any Special Conditions, as well as any contract concluded between CAWETTE JONES and the Purchasing Client, are set up and interpreted in accordance with French laws.

Article 15 – Litigation Management – Negotiation – Consumer Mediation – Jurisdiction clause

Disputes that may arise concerning the validity, interpretation, execution, non- performance, interruption or termination of the General Conditions, any Special Conditions and any contract, document , an agreement concluded between CAWETTE JONES and the Purchasing Client will be negotiated between them to define the most appropriate amicable solution. Any Customer has the right (and not the obligation), in case of dispute with CAWETTE JONES, to seize for free (except any personal expenses of lawyer or expertise) the mediator of the consumption chosen by CAWETTE JONES and approved by the Commission for Evaluation and Control of Consumer Mediation. The terms of referral of said consumer mediator are detailed on his own website. Thus, in particular, it is recalled that the Purchasing Client can only seize the consumer mediator if he has previously tried to resolve the dispute with CAWETTE JONES by means of a written complaint. The Purchaser Client has a period of one (1) year after his written complaint to CAWETTE JONES to seize the consumer mediator. If the solution proposed by the consumer mediator is not accepted by CAWETTE JONES and the Purchasing Client, the most diligent party has the right to submit the dispute to the competent courts. In this case, the disputes will be submitted to the exclusive jurisdiction of the courts of the jurisdiction of the Court of Appeal of Paris, notwithstanding the possible plurality of defendants, the incidental claims in forced intervention or appeal in warranty.

SPECIAL CONDITIONS REMOTE SALES DEPOSIT

1. Definitions and framework of the distance selling deposit service

These special conditions set up the relationship between CAWETTE JONES, its buyer client and its selling customer as part of the remote sale deposit service of CAWETTE JONES. They must first be read and accepted in their entirety by the buyer and the seller, without any reservation or conditions, so that the purchaser, duly informed, can proceed to the registration of his order and for the selling customer. The purchaser, duly informed, may proceed to the registration of his request for remote sale filing.

Purchasing client: any major consumer customer who is a natural person acting for purposes that do not fall within the scope of his commercial, industrial, artisanal, liberal or agricultural activity.

Sales clerk: A major physical person using CAWETTE JONES ‘remote sale deposit services to sell a property that belongs to him as of right.

Order: purchase made directly by the Purchasing Client on the CAWETTE JONES website, relating to a Product available in stock within the remote sale warehouse of CAWETTE JONES, with immediate and full payment of the price except in the case of payment in several installments .

Price: price fixed by CAWETTE JONES for the Products of the selling customers, appearing on the website of CAWETTE JONES at the time of the conclusion of the contract of purchase / sale, and to be paid by the Purchasing Client for the acquisition of the Product.

Product: Collector’s item, new or used, printed and painted, manufactured and produced following a prototype, in a limited number of copies, available only within the limit of the Stock, and intended for an audience of older people over 15 years old. The Product is not a toy, but a collector’s item. CAWETTE JONES reserves the right to sell the Products directly to its Customers on its website or at its partner boutiques.

Prototype: The model on which the Products are made.

Stock: set of products already made available at CAWETTE JONES and / or its partner shops. In the event of a breach of the Stock for a given Product, the order will be canceled and any payment paid by the Customer will be fully reimbursed by CAWETTE JONES as soon as possible, with the option for the Client to replace the Product with another Product of his choice, and possible refund of the difference if the chosen product is less expensive, or payment by the Customer of the surplus if the chosen product is more expensive.

No order or remote sale deposit request may be technically registered on the CAWETTE JONES website without the buyer or seller having first confirmed having read and accepted these special conditions.

The distance selling deposit allows the client (individual) to rely on the professional expertise of the Company CAWETTE JONES to sell effectively and serenely its derivative products collectors (resin statues, replicas, busts, …).

Thus, the seller client benefits from the various services offered by the CAWETTE JONES website such as installment payments, the personalized delivery service or the possibility of selling internationally, in order to sell his article optimally.

In return, the selling customer pays a variable commission (see section calculation of commissions below) to the company CAWETTE JONES.

The selling customer remains the owner of his article until his perfect reception with the buyer customer.

The selling customer is the sole responsible for the quality of the item on sale on the CAWETTE JONES website.

When the buyer client (individual) confirms the good reception of his product from the seller customer (in the form of a written confirmation by email within 48 hours after receipt to cawette.jones81@gmail.com), the company CAWETTE JONES pays to the customer seller the sum agreed when registering his product within the remote sales deposit.

The CAWETTE JONES remote sales deposit service is only available to sales customers in the 27 countries of the European Union.

 

2. Exclusions Products

The distance selling deposit service offered by CAWETTE JONES does not accept the following products:

– Toys or figurines assimilated (Myth cloth, POP, …) – Counterfeits and copies,

– The products are not under official license with the exception of the original creations of independent artists also called FAN ART or CUSTOM drawn in very low copies

– The products not having the quality required by our policy in terms of quality of production or general condition.

3. Calculation of commissions and bonus amount for distance selling deposit

The % of commission applied to the seller client’s product varies according to the price desired by the seller client.
It is between 20 and 25% of the total amount desired by the selling client according to the scale presented below:

  • Between €0 and €250: 25%
  • Between €251 and €500: 24%
  • Between €501 and €750: 23%
  • Between €751 and €1,000: 22%
  • Over €1001: 20%

The rates explained above are intended to cover all costs related to the management of the sale of your item (posting on the CAWETTE JONES site and on various partner merchant sites, transport management, assistance with potential disputes, payment solution).

The company CAWETTE JONES may in certain rare cases, refuse to take charge of a sale:

  • If the price requested by the selling customer is not in line with observed market prices.
  • If the condition and quality of the product do not correspond to the requirements advocated by our internal policy.

 

4. Remote Sale Filing Request Form

This form is the first essential step in the remote sale filing process. It is directly accessible on the CAWETTE JONES home page at the active “JE VENDS” button (I sale).

It aims to quickly check the eligibility of your article to our services according to the following criteria:

– The nature of the product (material, manufacturer, …)
– The condition of the product (complete, with original box, …) – The price requested by the customer

Following the transmission of this form by the selling customer, the company CAWETTE JONES judges if the article can be proposed to its buyers customers via the remote sale deposit service.

The company CAWETTE JONES undertakes to return you by mail within two working days maximum. If the company CAWETTE JONES accepts the product of the selling customer

within its distance selling deposit, the remote sale deposit request form provided by the seller client becomes a contractual part of the contract binding the two parties.

5. Documents to be provided by the seller client

The selling customer must provide all of the following elements either via the sales deposit request form or by mail:

– The name of the product (manufacturer, trade name, scale, …)

– The state of the product

– The price asked all tax included.

– Quality photos (minimum 3 photos showing the product, its packaging and its proof of authenticity if it exists)

– The double-sided photocopy of his identity card (by email following the acceptance of product within our sales depot).

The selling customer agrees on an exclusive period of 15 days. During this period, the selling customer agrees not to sell his product on other platforms individually.

6. Determination of the selling price – Payment – Reception

The buying customer pays the entire selling price to CAWETTE JONES including:
– The price fixed between the selling customer and the Company CAWETTE JONES

– The commission applied by CAWETTE Jones Company based on the selling price required by the selling customer and the possible bonus amount.

– The amount of the shipping costs (all tax included) according to the country of origin of the buyer customer.

The buyer client therefore pays a total amount of tax inclusive of these 3 components to the company CAWETTE JONES having previously selected the desired means of payment. When the whole payment (tax included) of the product is carried out by the buyer customer, the selling customer prepares the sending of his product by following scrupulously the procedure explained in “chapter 7 Preparation and protection of the sending” present within these Special Conditions remote sale deposit.

The purchasing customer confirms in writing and by email to the company CAWETTE JONES the perfect reception of the product from the seller client within 2 working days.

Following this written confirmation made by the buyer, the company CAWETTE JONES pays the seller customer the sum agreed between the two parties at the time of the application for deposit remote sale plus any bonus amount.

7. Shipping Preparation and Delivery Services

7.1 Preparation of the shipment

The selling customer undertakes to respect the procedure specified below when preparing his parcel before sending:

1) Check one by one the components of the product to make sure once again of their states before sending. If the salesman sees defects or other qualitative problems during packing, he must expressly notify the company CAWETTE JONES so that it can inform the customer buyer as soon as possible. The parcel can not be sent until the buyer has made his final decision regarding the problems revealed by the seller.

2) Position the various elements of the product in its original primary packaging (usually made of polystyrene) according to their original locations.

3) Effectively stall the various elements in their locations (using bubble wrap or other soft and non-abrasive material if necessary) to minimize the risk of breakage that may be caused by the handling of the package.

4) Reseal the polystyrene packaging in which the product parts are located using wide and good quality adhesive tape, taking care to circumnavigate the packaging. WARNING !!! The color box must not be closed with adhesive tape. This operation only concerns the inner polystyrene packaging.

5) Place the polystyrene inner packaging in its original color box, stalling it if necessary (using bubble wrap or any other soft and non-abrasive material) to reduce unwanted shock during handling of the package.

6) Place the set in the original brown cardboard box if present (brown shipper) or in a cardboard box with at least a double groove, taking care again that the original color box is well wedged within replacement outer carton. If this is not the case, re-wedge using bubble wrap or other protective and cushioning materials.

7) Close the 4 widths and 2 lengths of the outer brown cardboard with adhesive tape.

8) Circle the outer brown cardboard (brown shipper) of bubble wrap so that each side is covered with at least 2 layers and tape the set cleanly. WARNING !!! This step is very important to ensure maximum security of the shipment.

9) If the dimensions of the original packaging allow it, use a second shipping cardboard box in which you will place and effectively stall your product in its original packaging.

10) Print the packing slip and all the necessary transport documents (invoices, customs declaration) and tape them cleanly on your package (the use of a plastic bag is recommended to avoid any risk of tearing or degradation of documents).

11) To deposit your parcel at the post office of your choice (free service) OR to transmit your parcel to the deliveryman who will pass to your residence in the time slot of 4 hours selected by your care (service invoiced 25 € all tax included and reserved for the customers of France Metropolitan and Corsican under the “Custom Delivery Service”).

Shipments will or must be systematically insured up to their values.

7.2 Delivery Services

When a seller’s product is sold on the CAWETTE JONES website, the CAWETTE JONES company can take care of the whole shipping process (carrier selection, insurance, customs procedures) as part of the “service” service. « Personalized delivery ». However, this service is exclusively reserved for customers in mainland France including Corsica.

As part of the personalized delivery service, all documents necessary for the shipment will be sent by CAWETTE JONES to the seller by email within 48 hours with an explanatory note.

If the selling customer belongs to one of the 27 countries of the European Union except France including Corsica, he will have to manage his sending autonomously. However, the company CAWETTE JONES will accompany the seller customer during the preparation of the shipment by communicating all the necessary information by mail.

The selling customer must scrupulously follow the explanatory note provided to avoid certain inconveniences (blocking of the customs parcel, loss of the delivery note, etc.).

The sales customer has the choice between two types of services:

1) The withdrawal of the parcel at home or at the address of his choice in a time slot of 4 hours by a private carrier. This service is invoiced to the customer 25 € all tax included which will be deducted directly from the selling price of his product. Thus, the company CAWETTE JONES will pay to the seller customer the amount provided when registering his product in the remote sale deposit of the site CAWETTE JONES minus (-) home withdrawal (25 €).

2) The deposit of his package at the post office of his choice. The selling customer must stamp the proof of deposit provided by CAWETTE JONES. This proof of deposit will be asked to the selling customer in case of problems occurring during transport (loss, damage, …). This service is free and does not generate any additional costs for the seller.

8. Product reception and responsibilities

When the selling customer’s item is sold on our platform, the company CAWETTE JONES systematically manages the sending and delivery procedure.

Thus, the selling customer must only take care of the preparation and the protection of the package by methodically following the recommendations explained in chapter “7.1 Preparation of the sending”.

The company CAWETTE JONES deals with the whole procedure of sending (insurance, follow-up, customs procedure, …).

If the selling customer has not respected the protocol of preparation and protection of sending as stipulated in these Special Conditions, it will not be able to benefit from our service of assistance with the resolution of disputes in case of possible inconvenience that occurred while sending.

Shipments are systematically insured for the value of the goods and must be delivered against signature.

In addition, it is the buyer’s responsibility to inspect his parcel on receipt in the presence of the deliveryman and to notify any anomaly in writing on the carrier’s delivery note (damage, damage to the parcel, missing product compared to the voucher). delivery, broken products, delivery date not in accordance with the normal delivery service times …).

In the case of a shipment made by La Poste, if the package arrives open or damaged, it is essential that the Customer establishes by the driver a “report of spoliation” (finding 170) so that we can open an investigation and a compensation procedure.

The purchasing customer must also confirm this anomaly by sending the carrier within two business days following the delivery date, a registered letter with acknowledgment of receipt stating the said claims.
